Terms and Conditions

Please read these terms carefully before placing an order. By placing an order through paradewa.co.uk you agree to these terms.


1. WHO WE ARE

This website is operated by Para Dewa Limited ("Para Dewa", "we", "us", "our"), a company registered in England and Wales.

2. THESE TERMS

These terms apply to every order you place with us. Nothing in them affects your statutory rights as a consumer.

We may update these terms from time to time, for example to reflect changes in the law or in how we operate. The terms that apply to your order are the ones published on this website at the time you place it, so please check this page before ordering. We will keep the "last updated" date above current.

If you are buying as a business rather than as a consumer, these terms still apply to your order, but the sections describing statutory consumer rights (sections 9, 10 and 11) do not.


3. YOU MUST BE 18 OR OVER

It is against the law in the UK to sell alcohol to anyone under 18, and it is an offence for an adult to buy alcohol on behalf of someone under 18.

By placing an order for alcohol you confirm that:

- you are at least 18 years old;
- the person receiving the delivery is at least 18 years old; and
- you are not buying alcohol on behalf of anyone under 18.

We operate a Challenge 25 policy. If the person accepting delivery looks under 25, our courier will ask for proof of age. Acceptable proof is a valid passport, a UK photocard driving licence, a PASS-accredited proof-of-age card, or a digital proof of age issued through a service on the government's Digital Verification Services register.

If nobody aged 18 or over is available to accept the delivery, or acceptable proof of age is not produced, the courier will not leave the order. Alcohol will never be left in a safe place, in a porch, or with a neighbour without an age check being completed.

Where a delivery fails an age check, we will refund the price of the goods but not the delivery charge, and we may charge the cost of return carriage. We may refuse or cancel any order where we reasonably believe an age restriction is being breached, and we may close the account of anyone who tries to do so.


4. OUR PRODUCTS

We sell wine, wine experiences and related products such as gift sets and accessories, as described on this website.

We make reasonable efforts to ensure product descriptions, vintages and images are accurate. Wine is a natural, artisanal product from small-batch and independent producers, so vintages, labels and exact stock may vary from the images shown. Sediment in older or unfiltered wines, and light variation between bottles, are normal characteristics of the wines we sell and are not faults. Minor variations of this kind do not entitle you to reject an order unless the wine is materially different from the description, or faulty.

All products are subject to availability. If a wine you have ordered is unavailable, we will contact you as soon as possible and offer a substitute, a delay, or a full refund.

Where you have bought a curated case, a gift selection or any set we have put together rather than a specific named bottle, we may replace an unavailable wine with one of a similar style and of equal or greater value. We will tell you what we have sent, and if you would rather not keep the substituted bottle you can return it under section 9.

Allergen information, including sulphites and any fining agents relevant to vegan or vegetarian diets, is shown on the bottle label and on the product page where we hold it. If it is not shown for a wine you are considering, email us before you order and we will confirm it for you.

We describe wines as accurately as we can, but tasting notes, scores and drinking windows are opinions, not guarantees of how a wine will taste to you.


5. RETAIL SALE ONLY - NOT FOR RESALE

Para Dewa sells wine on a retail basis: to individuals, and to businesses buying for their own use or to give as gifts. We are not registered under HMRC's Alcohol Wholesaler Registration Scheme (AWRS) and are not authorised to sell alcohol wholesale, meaning for resale or onward supply by another business.

By placing an order, you confirm that you are buying as a private individual, or on behalf of a business buying for its own use or as gifts, and not for resale or onward supply.

We reserve the right to refuse, limit the quantity of, or cancel any order where we reasonably suspect the wine is being bought for resale or wholesale, including in the case of unusually large or repeated bulk orders.


6. PLACING AN ORDER

Our website invites you to place an order; it is not an offer to sell. The steps are:

1. You add wines to your basket and complete checkout.
2. We send an order acknowledgement by email. This is not acceptance of your order; it confirms we have received it.
3. When we dispatch the goods we send a dispatch confirmation. A contract between us is formed at that point, and only for the items listed in the dispatch confirmation.

We may decline an order, for example if the wine is out of stock, if we have identified an error in the price or description, if we cannot verify your age or payment details, if we cannot deliver to your address, or if we suspect the order is for resale. If we decline your order we will tell you and refund any payment taken in full.


7. PRICES AND PAYMENT

All prices are shown in pounds sterling and include UK VAT and duty where applicable. Delivery charges are shown separately and are added at checkout before you pay. The total you see before confirming is the total you pay.

We take payment at the time you place your order, using the payment methods shown at checkout. Payments are processed by Shopify Payments and other providers; we do not store your card details.

Prices can change, but a change will not affect an order we have already accepted. Despite our best efforts, a wine may occasionally be listed at an incorrect price. Where the error is obvious and you could reasonably have recognised it as a mispricing, we may cancel the order and refund you in full rather than supply at the wrong price. Where the error is not obvious, we will contact you before dispatch and you can confirm the order at the correct price or cancel it.


8. DELIVERY

Where we deliver

We deliver to addresses in mainland Great Britain (England, Scotland and Wales, excluding the Scottish Highlands and Islands). We do not currently deliver to Northern Ireland, the Isle of Man, the Channel Islands, BFPO addresses or outside the UK. If your address falls outside our delivery area, email us at divya@paradewa.co.uk and we will quote separately where we can.

Cost and timescale

Delivery charges are shown at checkout, and our current options, cut-off times and estimated timescales are set out on our Delivery page at paradewa.co.uk/pages/delivery. Timescales are estimates, not guarantees. In any event we will deliver within 30 days of the date of the contract unless we have agreed something different with you.

Rare wines and pre-arrival

Some limited releases are shipped to us to order, or released to us by the producer on a set date. Where that applies we will say so clearly on the product page, together with the expected despatch window, before you buy, and delivery will take longer than our standard timescale.

Accepting delivery

Someone aged 18 or over must be present to accept the delivery and, if asked, produce proof of age (see section 3). If delivery is attempted and nobody is available, our courier will leave a card and attempt redelivery or hold the parcel for collection. If an order is returned to us undelivered after failed attempts, we will refund the price of the goods less the outbound delivery charge and any return carriage we are charged.

Risk and ownership

The goods become your responsibility when they are delivered to you or to a person you have identified to take delivery. Ownership passes to you once we have received payment in full.

If delivery is late

If we miss the delivery deadline, you may treat the contract as at an end and receive a full refund where delivery within the agreed period was essential, where you told us that before ordering, or where we have failed to deliver within a further reasonable period you have given us.


9. YOUR RIGHT TO CHANGE YOUR MIND

If you are a consumer, you have a legal right to cancel your order within 14 days of the day you (or someone you have nominated) receive the wine, without giving a reason. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

How to cancel

Email divya@paradewa.co.uk with your order number, or use the model cancellation form available on request. A clear statement that you are cancelling is enough; you do not need to use any particular wording.

Returning the wine

You must send the wine back without undue delay and in any event within 14 days of telling us you are cancelling. Please email us first and we will give you the return address and a returns reference. The wine must be unopened, with seals and capsules intact, and in a condition that allows it to be resold. You are responsible for the cost of returning the goods and for packing them so they survive the journey; we recommend a tracked, insured service using proper wine packaging. We can arrange collection on your behalf and deduct the cost from your refund. Email us for a quote.

Your refund

We will refund the price you paid for the wine, together with the standard delivery charge you paid on the original order. If you chose a faster or more expensive delivery option, we refund the standard rate. We will refund within 14 days of receiving the wine back, or of you providing evidence that you have sent it, whichever is earlier. We may reduce your refund to reflect any loss in value caused by handling beyond what is necessary to establish what the wine is, for example a bottle that has been opened, a damaged label, or a broken seal.

When this right does not apply

The cancellation right does not apply to tickets for events and experiences taking place on a specific date (see section 12), or to en primeur or similar purchases where the price is agreed at the time of sale, delivery can only take place more than 30 days later, and the value depends on market movements.


10. IF SOMETHING IS WRONG WITH YOUR WINE

Your rights under the Consumer Rights Act 2015 apply in addition to, and separately from, the cancellation right above. The wine we send you must be as described, of satisfactory quality and fit for purpose.

- Within 30 days of delivery: you can reject a faulty bottle and get a full refund.
- After 30 days: you can ask for a replacement, and if that is not possible or does not resolve the problem, a refund.

Corked, oxidised or otherwise faulty bottles

Wine is a natural product and a small number of bottles are faulty. If a bottle is corked, oxidised or otherwise faulty, tell us within 14 days of opening it. Please keep the bottle, the remaining wine and the cork or closure, as we may ask you to return or photograph them so we can pass the fault back to the producer. We will replace the bottle or refund you, whichever you prefer, and we are happy to issue a credit note instead if you would rather have one. We cannot refund a bottle simply because you did not enjoy the wine.

Damaged or missing items

Please check your delivery on arrival. Tell us within 48 hours of delivery if anything has arrived broken, leaking or missing, with photographs of the outer box and the bottles where you can, and we will replace or refund the affected items. Telling us later does not remove your legal rights, but it does make a breakage claim harder for us to make good with the courier.

Storage after delivery

Once wine has been delivered it is in your care. We cannot accept responsibility for wine that has been affected by heat, frost or poor storage after it reached you.

11. GIFT ORDERS

If you are sending wine to someone else as a gift, everything in these terms still applies to you as the buyer, including the age restrictions in section 3. The recipient must be 18 or over and able to prove it on delivery.

We will send order updates to you, not to the recipient, so the surprise stays intact. The cancellation and faulty-goods rights in sections 9 and 10 sit with you as the buyer, not the recipient, and any refund is made to the payment method used for the order.


12. EVENT AND EXPERIENCE TICKETS

Some tastings and experiences are sold through this website as tickets. Where you buy one:

- Payment is due in full at the time of booking. Your place is confirmed when we send the booking confirmation.

- Tickets are non-refundable. Because these are services supplied on a specific date, the 14-day cancellation right in section 9 does not apply, under regulation 28 of the Consumer Contracts Regulations 2013.

- Tickets are transferable: if you can no longer attend, email us at least 48 hours before the event with the name and email address of the person taking your place and we will re-issue the ticket to them.

- If we cancel or reschedule. If we cancel an event, or move it to a date you cannot make, you will receive a full refund. We are not able to reimburse travel, accommodation or other costs you have incurred.

- Minimum numbers. Some events run subject to a minimum number of guests. If we do not reach it, we will tell you as early as we can and refund you in full.

- At the event. All guests must be 18 or over and may be asked for proof of age. We serve alcohol responsibly and our team may decline to serve any guest who appears intoxicated or whose behaviour affects other guests, without a refund. Please tell us about allergies or dietary requirements when you book, and at least 7 days before the event, so we can plan the wines and any food around them.

- Photography. We sometimes photograph our events for our website and social media. Tell a member of the team on the day if you would prefer not to appear, and we will make sure you don't.

Corporate tastings, private group bookings and bespoke experiences arranged directly with us, rather than bought as a ticket on this website, are governed by the separate proposal and terms we issue for that booking.


13. YOUR ACCOUNT AND OUR WEBSITE

If you create an account, keep your login details confidential and tell us promptly if you think someone else has used them. We may suspend or close an account that is being used in breach of these terms.

The content of this website, including text, tasting notes, photography, the Para Dewa name and logo, belongs to us or our licensors. You are welcome to view, share and print it for your own personal use; you may not reproduce it commercially without our permission.

We aim to keep the website available, but we do not guarantee uninterrupted access and we may suspend, withdraw or change any part of it without notice.


14. OUR RESPONSIBILITY TO YOU

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the goods, and for defective products under the Consumer Protection Act 1987.

If you are buying as a business, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability in connection with an order is limited to the price paid for that order.


15. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by events outside our reasonable control, including severe weather, fire, flood, strikes, transport failures, supplier or courier failure, and acts of government. If such an event occurs we will contact you as soon as possible and take reasonable steps to minimise the delay. If the delay is substantial you may cancel the affected order and receive a full refund.


16. COMPLAINTS

We would rather put something right than have you unhappy. Email divya@paradewa.co.uk with your order or booking number and what has gone wrong; we will acknowledge within two working days and aim to resolve the matter within 14 days.

If we cannot resolve it between us, you can seek free independent advice from Citizens Advice, and you retain the right to take a claim to court.


17. DATA PROTECTION

We use the details you give us when you order to process and deliver your order, to improve our service, and, if you have asked to hear from us, to tell you about events, new wines and other wine-related news. You can stop marketing emails at any time using the "unsubscribe" link at the bottom of any email we send.

To run the shop we share your details with the companies that host our website, take your payment and deliver your wine. We do not sell your data, and we do not pass it to anyone else for their own marketing.

We handle your information in line with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy, at paradewa.co.uk/policies/privacy-policy, sets out what we collect, why we collect it, how long we keep it, and the rights you have over it, including your right to complain to the Information Commissioner's Office.


18. GENERAL

These terms are between you and us. No one else has any rights to enforce them. If a court finds any part of them unlawful, the rest continues to apply.

If we do not insist that you do something you are required to do under these terms, or delay in taking steps against you, that does not mean we have given up any right we have against you.

These terms are governed by the law of England and Wales, and you and we both agree that the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country you live in.
